2. Definitions

Within this document, the terms shall have the following meanings:

"We", "our", "ours", "lexotique.ro"

Refers to THE GLAMS EMPIRE S.R.L., as the owner and operator of the www.lexotique.ro website.

"Site"

Refers to www.lexotique.ro, as well as all products, services, and content connected with lexotique.ro.

"Content"

The text, images, and all information presented on the www.lexotique.ro website, owned by lexotique.ro.

"User"

The natural or legal person who has or obtains access to the content as a visitor to the site for viewing it, without necessarily requiring the creation and use of an account.

"Member"

The natural or legal person who has or obtains access to the content through the creation and use of an Account.

"Customer"

The natural or legal person who has or obtains access to the content and service following the creation of a Member Account and/or the placing and receipt of an order.

"Account"

The set consisting of an email address and a password that allows a single Member access to restricted areas of the Site through which access to the Service is made.

"Order"

The expression of the desire to purchase one or more products and/or services through the www.lexotique.ro website, the Facebook page, or WhatsApp, made by a Customer who wishes the respective product(s) to be delivered to the address indicated by them.

"Newsletter / Alert"

The means of periodic information, exclusively electronic, on the products, services, and/or promotions carried out by lexotique.ro during a certain period, without any commitment on the part of lexotique.ro with reference to the information contained therein (stocks, maintaining prices, promotions, etc.).

"Transaction"

Collection or refund of an amount resulting from the sale of a product/service by lexotique.ro from/to the Customer, through the use of the card processor's services agreed by lexotique.ro or through the cash-on-delivery systems of courier companies, regardless of the delivery method.

3. General Provisions

3.1 User Responsibility

By using the Site/Content, the User, Member, or Customer is solely responsible for all activities arising from its use. Furthermore, they are liable for any material, intellectual, electronic, or any other type of damage caused to the Site/Content, lexotique.ro, or any other third party with whom lexotique.ro has concluded contracts, in accordance with the Romanian legislation in force.

3.2 Right to Modify

lexotique.ro reserves the right to modify, whenever necessary, the content of the site, the products/services, as well as the terms and conditions, without prior notice to members, customers, or users.

3.3 Newsletters and Commercial Communications

The User, Member, and/or Customer agrees to receive newsletters/alerts transmitted by lexotique.ro through electronic channels. lexotique.ro reserves the right to select the persons to whom it will send newsletters/alerts, as well as the right to remove from its database any User, Member, or Customer who has previously expressed consent to receive newsletters/alerts, without any subsequent commitment on the part of lexotique.ro or prior notification thereof.

3.4 Access Limitation

lexotique.ro reserves the right to limit the Customer/Member's access to the Service and even to delete their Account if it considers that, based on the Customer's behavior, the access and existence of their Account could prejudice lexotique.ro in any way. This right may be exercised at any time and no notification of the Customer is required.

3.5 Third-Party Services

lexotique.ro uses the services of other companies, for example for transport, payment, etc. Responsibility for these services lies entirely with the service-providing companies. It is the responsibility of the user/member/customer, before using these services, to be aware of and accept their conditions and terms.

3.6 Limitations of Responsibility

lexotique.ro has no responsibility regarding:

• Inconveniences caused by the interruption of access to the site due to the internet service provider;
• The possibility of contracting viruses through accessing the www.lexotique.ro site or by receiving emails of an informational or promotional nature;
• The content or nature of the sites through whose links a customer reaches the www.lexotique.ro site.

3.7 No Warranties

lexotique.ro offers no direct or indirect warranties that the products/services obtained free of charge or for a fee through the service (site) will meet the Customer's requirements or expectations.

4. User Registration and Customer Account

4.1 When Registration is Required

For accessing the presentation sections of the site, registration is not required. User registration becomes mandatory only in the following situations:

• Subscribing to the newsletter;
• Placing an order;
• Accessing restricted areas of the site.

4.2 User Obligations Upon Registration

In order to benefit from the services offered, you undertake and warrant:

1. To provide real, accurate, and complete data about yourself, in accordance with the registration form;
2. To maintain and update the registration data so that it is permanently in accordance with reality.

The site owner reserves the right (but not the obligation) to verify the correctness of the data provided. In case of finding inaccurate information, we reserve the right to refuse access to services.

4.3 User Account

The account can be accessed by means of a password, known only by you. You are fully responsible for:

• Keeping the password and authentication information safe;
• All operations performed through your account;
• Not disclosing the authentication data to third parties.

Acceptance of the Terms and Conditions is confirmed by:

• Ticking the corresponding checkbox on the site;
• Sending an order;
• Making an online payment.

5. Privacy Policy

5.1 Data Confidentiality

lexotique.ro guarantees the confidentiality of the data hosted and transmitted through its IT system by customers at the time of their registration on the site. This information may be used to send Users/Members/Customers order confirmations, various special offers, promotions, etc., only with their prior consent.

5.2 Consent Regarding Data Processing

By creating the Account, calling the phone number displayed on the site, or sending a message using the contact form, each Member or Customer expresses their consent for lexotique.ro to collect and administer personal data and use it for the purposes mentioned on this terms and conditions page (marketing, delivery, invoicing, etc.).

5.3 Correcting Data

If some of the personal data is incorrect, the Member/Customer must inform lexotique.ro as soon as possible, using the contact details displayed in this "Terms and Conditions" document.

6. Orders, Prices, and Payment Methods

6.1 Rules for Orders

• The use of the site is carried out exclusively for placing legitimate orders or for information purposes;
• The User refrains from formulating any false or fraudulent order;
• The information provided must be real, complete, and up to date;
• Intellectual property rights over the elements on the site must be respected;
• It is forbidden to carry out any action that could harm the site.

We reserve the right to block the access of any user who violates these rules and to address the competent authorities for the recovery of damages.

6.2 Prices

The prices displayed on the site include VAT, are set entirely by the seller, and are non-negotiable. Prices will be subject to changes whenever lexotique.ro considers necessary, without prior notice to customers or potential customers.

The purchase price on the invoice will be the same as the one displayed on the site at the time of purchase, to which, where applicable, the delivery costs are added.

6.3 Payment Methods

For making payments, we use the services of the payment processor Netopia (MobilPay). Any information related to payments is encrypted, using HTTPS technology with TLS encryption.

If card payment is not chosen, the Site Customer may pay:

• Cash on delivery — at the time of delivery of the order;
• By bank transfer (payment order) — all necessary information (IBAN, bank, etc.) will be transmitted after the order is finalized.

We are not responsible for the erroneous processing of the payment or for errors recorded through the payment system.

6.4 Invoicing

For each purchase, we will issue a fiscal invoice. It will be transmitted to the Customer together with the ordered products or by email. Once issued, the invoice can no longer be modified except under the conditions provided by law.

7. Product Delivery Policy

7.1 Delivery Term

Any order will be delivered within the limit of available stock. The order processing term is 1–3 working days. The product delivery term is between 1 and 3 working days from the moment the order processing is completed (handover to the courier). On non-working days and legal holidays, no order processing or deliveries are carried out.

7.2 Busy Periods

During busy promotional periods, order processing and delivery may take longer than 1–3 working days.

7.3 Courier Company

The delivery of products by THE GLAMS EMPIRE S.R.L. is ensured by a courier company with which a delivery contract has been previously concluded. Due to the fact that delivery is made through a third-party agent, we cannot guarantee the quality of the service. However, for any issue regarding the delivery process, do not hesitate to contact us.

7.4 Damaged Parcels

7.5 Incomplete Information

Due to information provided incorrectly or incompletely by the buyer, the seller does not guarantee compliance with delivery deadlines. In certain cases, the order may be canceled by the seller.

7.6 Suspicious Orders

The seller has the right to refuse suspicious orders (a very large number of products ordered or repetition of returned orders).

8. Return Policy and Right of Withdrawal

8.1 Legal Term

According to the legislation in force (GEO 34/2014), you may return the purchased product(s) within 14 calendar days from the date of receipt of the parcel, without having to justify the decision and without additional costs, except for the direct costs of return.

8.2 Return Conditions

• The product must be in the same condition in which it was received, with the label attached;
• The return of the product shall take place within a maximum of 14 calendar days from the date of receipt of the parcel;
• All returned products will be checked in terms of quality and compliance with the return conditions above.

8.3 Withdrawal Procedure

The intention to withdraw must be announced in writing, by email at contact@lexotique.ro, specifying:

• The name on which the order was placed;
• The order number;
• The product(s) you wish to return.

THE GLAMS EMPIRE S.R.L. will respond by email or telephone within 1–3 working days with the return instructions.

8.4 Refusal of the Return Request

THE GLAMS EMPIRE S.R.L. reserves the right to refuse the return request if, following its own verifications, the returned product does not comply with the return conditions mentioned in this section.

9. Copyright and Intellectual Property

9.1 Protected Content

The www.lexotique.ro site and all its elements — web graphics, texts, programs, images, logos, stylized representations, symbols, photographs, audio-video materials — are protected by the copyright law and are the exclusive property of THE GLAMS EMPIRE S.R.L. or its suppliers.

9.2 Usage Restrictions

As a user, you do not have the right to:

• Partially or entirely modify the site;
• Reproduce, copy, sell, or exploit the site in any manner;
• Distribute, transmit, display, publish, or grant licenses on the content;
• Create derivative products;
• Remove the marks, logos, or any identifying elements;
• Use automatic or manual devices to monitor the materials.

The use without our written consent of any element contained in this site is punishable according to the laws in force.

10. Prohibited Uses

In addition to other prohibitions set forth, it is forbidden to use the site or its content:

1. For any illegal purpose;
2. To solicit others to perform or participate in illegal acts;
3. To violate any national and European regulations, rules, laws, or ordinances;
4. To infringe our intellectual property rights or those of others;
5. To harass, abuse, insult, harm, defame, slander, intimidate, or discriminate on the grounds of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
6. To submit false or misleading information;
7. To upload or transmit viruses or any other code that affects the functionality of the site;
8. To collect or track the personal information of others;
9. For spam, phishing, pharming, pretexting, spider, crawl, or scrape;
10. For any obscene or immoral purpose;
11. To interfere with or circumvent the security features of the site.

We reserve the right to terminate your use of the site in the event of any prohibited use.

11. Limitation of Liability

THE GLAMS EMPIRE S.R.L., its representatives and consultants make no representation, promise, or warranty regarding the accuracy, completeness, or adequacy of the products or materials presented on the site, and assume no obligation of result.

11.2 Assumption of Risk by the User

We are not responsible for:

• Material, financial, data, or information losses caused directly or indirectly by the information on the site or by its improper functioning;
• Damage to your computer or viruses that may infect your equipment;
• Errors, omissions, interruptions, deletions, defects, delays in operation or transmission;
• Theft, destruction, or unauthorized access to data;
• The content, accuracy, or practices of third-party sites referenced by links on the site.

12. Force Majeure and Fortuitous Events

We shall not be held liable for delays or failures in performing the services in the event of a force majeure or fortuitous event, which include, but are not limited to:

• Changes in laws or regulations;
• Accidents, diseases, embargoes, wars, acts of terrorism, riots;
• Fires, earthquakes, nuclear accidents, floods;
• Strikes, extreme weather conditions;
• Acts of hackers or internet service providers.

Force majeure or fortuitous events shall be communicated to the Customer as soon as possible.

13. Notifications and Communications

The User agrees that all communications made under this contract shall take place by electronic mail, at the address contact@lexotique.ro. Such a communication is valid by simple proof from the Seller of its sending.

The Seller has the right to use other methods of transmission (post, courier, bailiffs) for its communications to the User.

14. Complaint Resolution Procedure

Any dissatisfaction related to accessing, using, registering on the site, placing an order, or other similar aspects shall be communicated to us directly by email at contact@lexotique.ro.

The dissatisfaction will be registered and you will receive a written response, at the email address mentioned, within no more than 10 working days.

For alternative dispute resolution, consumers may also address the European online dispute resolution platform (ODR), accessible at: https://ec.europa.eu/consumers/odr, or the National Authority for Consumer Protection (ANPC).

15. Changes to the Terms and Conditions

We reserve the right to make changes at any time regarding the content of the site, the policy, the terms and conditions of use, without prior notice, although we will make efforts to inform customers about these changes.

If you do not agree with the changes, please cease using the site. Continued use is equivalent to accepting the changes.

16. Applicable Law and Disputes

This agreement, as well as any use of the site, is governed by Romanian law.

The parties shall try to resolve any misunderstanding amicably. Otherwise, the disputes shall be settled by the competent courts at the headquarters of THE GLAMS EMPIRE S.R.L., respectively in Brasov, in accordance with the Romanian laws in force.

17. Final Clauses

These terms govern Users' access to the www.lexotique.ro site. In the event of the subsequent implementation of additional functions or services, these will be subject to the same rules and conditions, except for cases in which they will benefit from distinct conditions.

By accessing the site, you accept the conditions described and agree that it has the value of a contract tacitly accepted between the User and the site owner.

These Terms and Conditions are supplemented by special provisions contained in the description of the products available on the site. In case of contradictions, the special provisions shall take precedence.

17.1 Promotions

Promotions are announced on the site, become valid at the moment of activation, and cease at the moment of deactivation. Promotions do not accumulate with each other or with other discounts and are valid only within the limits and in compliance with the conditions on the site.
